Reconhe\u00e7a que o ass\u00e9dio sexual est\u00e1 acontecendo<\/h2>\n<p>Voc\u00ea pode pensar que sua organiza\u00e7\u00e3o n\u00e3o tem um problema porque voc\u00ea n\u00e3o tem uma preval\u00eancia de den\u00fancias de ass\u00e9dio sexual. <a href=\"https:\/\/nwlc.org\/resources\/metoowhatnext-strengthening-workplace-sexual-harassment-protections-and-accountability\/\" target=\"_blank\" rel=\"noopener noreferrer\">Setenta por cento (70%)<\/a> dos trabalhadores n\u00e3o denunciam o ass\u00e9dio por medo de perder seus empregos, medo de retalia\u00e7\u00e3o (ou seja, hor\u00e1rios de turno ruins, atribu\u00eddos a tarefas mais perigosas, avalia\u00e7\u00f5es de desempenho ruins) ou a cren\u00e7a de que nada ser\u00e1 feito para impedir o ass\u00e9dio.<\/p>\n<p>Alega\u00e7\u00f5es de ass\u00e9dio sexual s\u00e3o mais prevalentes em ind\u00fastrias com <a href=\"https:\/\/nwlc.org\/wp-content\/uploads\/2017\/12\/MeToo-Strengthening-Workplace-Sexual-Harassment-Protections.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">desequil\u00edbrios de poder gritantes<\/a>. Entre\u00a0<a href=\"https:\/\/www.americanprogress.org\/issues\/women\/news\/2017\/11\/20\/443139\/not-just-rich-famous\/\" target=\"_blank\" rel=\"noopener noreferrer\">2005 \u2013 2015<\/a>, a maior porcentagem de acusa\u00e7\u00f5es de ass\u00e9dio veio de ind\u00fastrias de servi\u00e7os de alimenta\u00e7\u00e3o e acomoda\u00e7\u00e3o, incluindo restaurantes de servi\u00e7o completo, QSRs, lojas virtuais, instala\u00e7\u00f5es recreativas, hot\u00e9is e pousadas. Outras ind\u00fastrias importantes s\u00e3o o com\u00e9rcio varejista, sa\u00fade e manufatura.<\/p>\n<p>Se sua organiza\u00e7\u00e3o se enquadra em um dos setores acima, voc\u00ea pode presumir que o ass\u00e9dio est\u00e1 ocorrendo, seja denunciado ou n\u00e3o. O primeiro passo para proteger seus funcion\u00e1rios e sua empresa \u00e9 reconhecer que o ass\u00e9dio pode acontecer e ser preventivo ao identific\u00e1-lo e lidar com ele.<\/p>\n<h2>2. Tenha uma defini\u00e7\u00e3o clara de ass\u00e9dio sexual em sua pol\u00edtica<\/h2>\n<p>\u00c9 importante ter uma defini\u00e7\u00e3o clara do que \u00e9 ass\u00e9dio e o que n\u00e3o \u00e9. Por exemplo, o <a href=\"https:\/\/www.dol.gov\/oasam\/programs\/crc\/2011-workplace-harassment.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Departamento do Trabalho dos EUA<\/a> define dois tipos principais de ass\u00e9dio ilegal:<\/p>\n<h3><strong>1. Ass\u00e9dio Quid Pro Qua<\/strong><\/h3>\n<p>Esse tipo de ass\u00e9dio normalmente tem o padr\u00e3o \u201cSe voc\u00ea fizer isso, eu farei aquilo por voc\u00ea\u201d ou \u201cSe voc\u00ea n\u00e3o fizer isso, a consequ\u00eancia ser\u00e1 aquela\u201d.<\/p>\n<p>Esse tipo de ass\u00e9dio geralmente resulta em decis\u00f5es de emprego (rescis\u00e3o, promo\u00e7\u00e3o, oportunidade) com base em se o funcion\u00e1rio aceita ou rejeita avan\u00e7os sexuais indesejados.<\/p>\n<h3><strong>2. Ass\u00e9dio em ambiente de trabalho hostil<\/strong><\/h3>\n<p>Conduta indesejada de colegas de trabalho, supervisores e\/ou clientes (ou qualquer pessoa no local de trabalho) cuja conduta crie uma atmosfera intimidadora, ofensiva ou hostil para um funcion\u00e1rio visado.<\/p>\n<p>Ao elaborar sua defini\u00e7\u00e3o e pol\u00edtica, certifique-se de fornecer exemplos concretos de comportamento inaceit\u00e1vel e aceit\u00e1vel. Use linguagem simples e evite jarg\u00f5es jur\u00eddicos.<\/p>\n<p>Al\u00e9m disso, use uma linguagem culturalmente relevante e espec\u00edfica para definir o comportamento e remover a subjetividade. Por exemplo, o <a href=\"https:\/\/hbr.org\/2017\/05\/the-omissions-that-make-so-many-sexual-harassment-policies-ineffective\" target=\"_blank\" rel=\"noopener noreferrer\">Harvard Business Review<\/a> recomenda adicionar linguagem como: \u201cAss\u00e9dio sexual \u00e9 uma forma de <strong>predat\u00f3rio<\/strong> comportamento sexual em que uma pessoa <strong>alvos<\/strong> outros funcion\u00e1rios\u201d. Ao usar termos como \u201cpredat\u00f3rio\u201d e \u201calvo\u201d em vez de \u201cperpetrador\u201d e \u201cv\u00edtima\u201d (que t\u00eam associa\u00e7\u00f5es culturais conhecidas com certos g\u00eaneros), as empresas podem reformular a forma como os funcion\u00e1rios interpretam as pol\u00edticas para incentivar a ado\u00e7\u00e3o de pol\u00edticas.<\/p>\n<p>Mesmo com uma defini\u00e7\u00e3o espec\u00edfica, esteja ciente de que pode haver certos incidentes de ass\u00e9dio sexual que n\u00e3o se enquadram perfeitamente na defini\u00e7\u00e3o da sua empresa. Comunicar, distribuir e exibir pol\u00edticas de ass\u00e9dio sexual<\/h2>\n<p>\u00c9 importante comunicar e distribuir sua pol\u00edtica em v\u00e1rios canais para que ningu\u00e9m fique desprevenido.
